Privacy Policy for Traxinity

This Privacy Policy describes how Traxinity ("we," "us," or "our") collects, uses, discloses, and protects the personal information of users ("you" or "your") of the Traxinity mobile application (the "App").Traxinity Inc. (“Traxinity”, “we”, “us”, or “our”) wants you to be familiar with our privacy practices, which seek to comply with applicable legislation, including the Personal Information Protection and Electronic Documents Act and, in case of data processing falling within its territorial scope, the European Union’s regulation No. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, also known as the general data protection regulation (the “GDPR”). This privacy policy (“Policy”) describes how we collect, use, transfer and disclose personal information that you provide to us when you visit our website: Traxinity.com (“Website”), when you register for an account and use our platform (“Platform”) and during any other interactions with us.
By visiting our Website, registering for an account and using our Platform, or otherwise interacting with us, you consent to – or, for GDPR purposes, you acknowledge you are informed of – the collection, use, transfer and disclosure of your personal information by Traxinity in accordance with the terms of and for the purposes set out in this Policy, as they may be amended from time to time.

1. Information We Collect
1.1 Personal Information:
We may collect personal information that you voluntarily provide to us when using the App, such as your name, email address, contact information, and any other information you choose to provide.
1.2 Device Information:
We may collect certain information about your device, including unique device identifiers, operating system version, mobile network information, location and other technical information about your device.
1.3 Usage Information:
We may collect information about how you use the App, including the features you access, location, the pages you visit, and the actions you take.
2. Use of Information
2.1 Provide and Improve the App:
We use the collected information to provide and improve the functionality of the App, enhance your user experience, and respond to your inquiries or support requests.
2.2 Personalization and Analytics:
We may use the information to personalize your experience, understand usage patterns, and perform data analysis to improve the App's performance and features.
2.3 Communication:
We may use your contact information to communicate with you, respond to your feedback or inquiries, and provide you with important updates or information related to the App.
3. Disclosure of Information
3.1 Service Providers:
We may share your personal information with third-party service providers who assist us in operating and maintaining the App, such as hosting providers, location services, analytics providers, and customer support providers. These service providers are authorized to use your personal information only as necessary to provide services to us.
3.2 Legal Requirements:
We may disclose your personal information if required to do so by law or in response to valid legal requests from public authorities, such as government agencies or courts.
4. Data Security
We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, please note that no method of transmission over the internet or electronic storage is 100% secure.
5. Location Information
We collect your device's precise location to support core features of the App. Specifically, location is used to record the on-site location of your clock-in and clock-out events; to record the on-site location of asset, tool, bin, and electronic check-in and check-out events; and to suggest the closest job site or geofence so that you do not have to enter it manually.
We collect location only while you are actively using the App, and only at the moment you take one of the actions described above. We do not collect your location in the background, while the App is closed, or while your device's screen is off.
The location coordinates we collect are attached to the corresponding work event and sent to your employer's Traxinity workspace so that timesheets, asset records, and job reports are accurate. We do not sell your location data, and we do not share it with third-party advertisers.
Location access is required in order to clock in, clock out, and check tools, assets, bins, and electronics in or out. You may decline or revoke location permission at any time through your device settings; however, if location permission is not granted, these features will be unavailable until you re-enable location access for Traxinity. Any precise location collected in connection with a work event is retained and deleted in accordance with the "Data Retention" and "Deleting Your Account and Data" sections of this policy.
6. Data Retention
We retain personal information for as long as is necessary to provide the App and the Platform, to operate our business, to meet our contractual obligations to the employer or organization (each, a "Customer") that has engaged us to provide the Platform on its behalf, and to comply with our legal, accounting, tax, employment, and audit obligations under applicable law.
How long we keep any particular category of information depends on the nature of that information, the purposes for which it was collected, and the requirements of the Customer that deployed the Platform in their organization. In general:
Account information (such as your name, email address, contact information, and authentication credentials) is retained for the lifetime of the Customer's account and for a reasonable period thereafter to support offboarding, dispute resolution, and our own internal record-keeping.
Work event records (including clock-in and clock-out events; asset, tool, bin, and electronic check-in and check-out events; and any precise location attached to those events at the moment they are recorded) are retained for as long as the Customer's Traxinity workspace remains active, and for an additional period thereafter as needed to support payroll, audit, employment, tax, and other record-keeping obligations applicable to the Customer. In many jurisdictions this additional period is measured in several years.
Device, technical, and usage information is retained for the period necessary to operate, secure, and improve the Platform, after which it is either deleted or aggregated and irreversibly anonymized so that it can no longer be associated with an identifiable individual.
Support communications and other correspondence are retained for a reasonable period after the matter is closed in order to preserve a record of the interaction and any commitments made.
Because we operate the Platform on behalf of our Customers, the Customer is, in most cases, the controller of the personal information described above for the purposes of applicable privacy laws, and our handling of that information — including how long it is retained, when it is deleted, and how requests from individual end users are processed — is governed by our agreement with that Customer.
The Platform replicates data across primary, redundant, and backup systems for reliability and security. For that reason, deletion of data from our active production systems may take additional time to propagate fully to backups, after which the data is retained only in inaccessible backup form until those backups are rotated out of existence in the ordinary course of business.
7. Deleting Your Account and Data
You can request deletion of your Traxinity account and its associated personal information at any time by emailing us at support@traxinity.com. When we delete an account at a user's request, we delete the personal information associated with that account, subject only to the retention exceptions described below.
Because we operate the Platform on behalf of our Customers, the employer or organization that provides you with access to Traxinity is, in most cases, the controller of your personal information. If you are an end user, we recommend that you first contact that employer or organization, as they are typically best positioned to action your request. Where you contact us directly, we will action your request ourselves where we are able to, and otherwise coordinate with the relevant Customer so that it is processed without undue delay and in accordance with applicable law.
Certain information may be retained after account deletion where we are required or permitted to keep it — for example, the work event and time records described above that are needed to meet a Customer's payroll, tax, employment, and audit obligations, or information retained for security and fraud prevention. In those cases the data is retained only for as long as the applicable obligation requires, and the propagation and backup timing described under "Data Retention" applies equally to deletion requests.
8. Children's Privacy
The App is not intended for use by individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information without parental consent, please contact us, and we will promptly delete such information.
9. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. Any changes will be effective immediately upon posting the revised Privacy Policy on the App. We encourage you to review this Privacy Policy periodically to stay informed about how we collect, use, and protect your personal information.
